Moscow Arbitration Court Did Not Declare Intravel Stoleshniki Bankrupt

On June 6, the Moscow Arbitration Court rejected the application of Intravel Stoleshniki Tourist Company LLC to declare it insolvent (bankrupt).

 

 

“Refuse OOO TK Intravel Stoleshniki (OGRN 1147746951857, INN 7707842300) to satisfy the application on recognizing him as insolvent (bankrupt) under the simplified procedure of a debtor in liquidation. The proceedings on the case shall be terminated. The decision may be appealed to the arbitration court of appeal (the Ninth Arbitration Court of Appeal) within one month from the date of preparation in full," the court's decision, published on the website, states.

Based on the case materials, it was confirmed that the evidence presented by the applicant does not clearly confirm the circumstances of the insufficiency of the debtor's property to satisfy the creditors' claims, since the size of the assets is significantly greater than the size of the Company's liabilities, and the debtor did not provide information about the property.

"Thus, in accordance with Articles 3, 224, 225 of the Federal Law, the liquidator of the debtor did not provide evidence confirming the presence of signs of bankruptcy of the liquidated debtor: insufficiency of the value of the debtor's property to satisfy the claims of creditors. In addition, evidence of publication in the press of information on the liquidation of OOO TK Intravel Stoleshniki, on the procedure and deadlines for filing creditors' claims, are also absent from the case materials," the department's decision notes.

Let us recall that on January 24, during a court hearing to consider the company’s bankruptcy case, it became known that the tour operator Intravel Stoleshniki owes its creditors about half a million rubles.

Let us add that the tour operator Intravel Stoleshniki announced the termination of its activities on July 20, and later, on August 15, the company filed a bankruptcy petition with the arbitration court.
