Court: Former DSBW CEO Karen Goncharov Illegally Sold Apartment Worth 65 Million

The Moscow Arbitration Court has declared the sale of the apartment of former DSBW-Tours director Karen Goncharov to SDM-Bank illegal. The corresponding decision has been published in the court's case file.

 

 

Let us recall that earlier the TRN portal learned that shortly Before the bankruptcy procedure was introduced, the former head of DSBW gave 25/28 shares of his apartment on Bolshaya Ordynka to his children. In addition, Goncharov sold a second apartment, also located on Bolshaya Ordynka, to SDM Bank. However, the debtor's financial manager, Mark Varnavsky, doubted the legality of these transactions, filing applications (1, 2) to the court to invalidate them (more details at the link: https://www.trn-news.ru/news/88808).

At the same time, lawyers noted that such actions most often indicate that a person planning to become bankrupt is trying to avoid fulfilling his obligations to creditors or to give some creditors an advantage over others.

And on one of the applications, the court shared this position. "To declare the Agreement of Sale and Purchase of an apartment located at the address: Moscow, Bolshaya Ordynka St., Building 31/12, Building 1, Apt. 7, with a total area of 94.3 sq. m. invalid. To apply the consequences of the invalidity of the transaction in the form of returning the said real estate to the ownership of Karen Evgenievich Goncharov. To restore Karen Evgenievich Goncharov's debt to SDM-Bank (PJSC) in the amount of 65 million rubles," the ruling says.

As Petr Gusyatnikov, Senior Managing Partner of the law firm PG Partners, explained to the TRN portal, the court's decision indicates that only one creditor, SDM Bank, was in a winning position in this transaction. In turn, the others received nothing. "After the transaction was declared invalid, the apartment will be returned to the so-called bankruptcy estate - the debtor's property, which will be sold at auction. The money from its sale will be distributed among all creditors," the expert explained.
