The Novosibirsk Kalininsky District Court has satisfied the recourse claim of the insurance company Liberty Insurance against the general director of the tour operators Akris-Intourist and Akris Travel Vladimir Kourov for the recovery of the paid insurance compensation in the amount of 8.04 million rubles.
As reported by the insurer’s press service, Mr. Kourov did not voluntarily comply with the court’s decision, and as a result, the procedure for forced recovery of compensation for property damage was initiated.
Let us recall that on December 3, 2014, the Akris Group reported the impossibility of fulfilling its obligations to tourists. The civil liability of tour operators ZAO Akris-Intourist and ZAO Akris Travel for failure to fulfill or improper fulfillment of obligations under the contract for the sale of a tourist product was insured by Liberty Insurance (AO). The insurer acknowledged the occurrence of the tour operator's liability and made insurance payments to the affected tourists.
On July 4, 2017, a court ruling came into force to terminate the criminal prosecution against Kourov, accused of committing 139 episodes of crimes under Part 1 of Article 159.4 of the Criminal Code of the Russian Federation (fraud), due to the expiration of the statute of limitations, which, according to the law, is not a rehabilitating circumstance.
“Liberty Insurance Company filed a recourse claim against Mr. Kourov as the head of tour operators, whose deliberate illegal actions caused property damage to the insurer and clients of the travel agencies he headed,” the insurer’s press service emphasized.
They also noted that since Kourov did not provide evidence proving his innocence, the Kalininsky District Court of Novosibirsk decided to collect 8.04 million rubles in compensation for property damage from him. The Novosibirsk Regional Court upheld this decision.
